Please note that Men In Kilts Franchise Services Inc may also own other trademarks, service marks or logos and their absence from this list does not constitute a waiver of any intellectual property or other rights that Men In Kilts Franchise Services Inc may have in those marks.

 

Trademark use requirements

If you wish to utilize any of Men In Kilts trademarks in connection with your application or product, you are required as a condition of such use to abide by any usage guidelines Men In Kilts may publish from time to time and, further, you shall be deemed to acknowledge and agree as follows:

1. Men In Kilts owns any and all rights to Men In Kilt’s trademark(s) and the substantial goodwill in those marks;

2. the use or display of Men In Kilt’s trademarks in connection with your application or other product shall not create any right, title or interest, in or to the Men In Kilts trademarks and all such uses and goodwill associated with such trademarks shall inure to the benefit of Men In Kilts;

3. you shall ensure that whenever any of Men In Kilt’s trademarks is used in advertising or in any other manner, it shall be clear that Men In Kilts is the owner of each such trademark;

4. Men In Kilts shall have the sole right and discretion to bring legal or administrative proceedings to enforce its rights in its trademarks, including actions for trademark infringement or unfair competition proceedings;

5. you will not, directly or indirectly, challenge Men In Kilt’s use, ownership or registration of Men In Kilt’s trademarks;

6. you shall not use Men In Kilt’s trademark(s) in any manner likely to deceive or cause confusion in trade or jeopardize the exclusiveness or distinctiveness of Men In Kilt’s trademarks, or in a fashion or manner that is likely to reduce, diminish or damage the goodwill, value or reputation associated with the Men In Kilts’s trademarks;

7. you will not use any other trademark or service mark in proximity to any of Men in Kilt’s trademarks or combine the marks in a manner, which would create a combination mark or a single commercial impression;

8. you will not alter Men In Kilt’s trademarks in any way without the prior written express approval of Men In Kilts; and

9. you will not use, adopt or register any product, trade or business name, service mark or trademark likely to cause confusion with Men In Kilt’s trademarks.
